Dear Zack and Andre:

I just thought that I would let you know that I read the following on
Neowin.net: Builds 5342 and 5365 are Microsoft Internal Builds. This means
that they (5342 and 5365) are indeed under a Microsoft NDA, because they are
Microsoft Internal Builds (all Microsoft Internal Builds are always under a
Microsoft NDA).

You, as usual, are laboring under a false premise.

"Microsoft Internal Builds" are *exactly* what their name implies:
"internal-to-Microsoft" builds which are not available outside Microsoft.

Once a build is made available to non-Microsofties, they're not "internal builds".

Windows Vista is not under NDA...period.

NeoWin is not Microsoft, I have 5365 build and the EULA does not say such
nonsense. Honestly, that site needs to be shutdown for 10 years.

Nothing about Vista builds is yet public. In the past, MS always considered
beta releases to parties as NDA releases. This did not matter whether it
was an official release build, or a weekly internal build. You get the
release because you are part of an accepted group. I don't think this has
changed with Vista.

Microsoft regularly makes internal builds available to accepted group
members who are not part of MS. However the constraints about release of
information and product still apply.
