What program(s) poll the DVD drive at boot up, waking from sleep or restart?
It has been determined that the drive [new] is sound and works as designed.

No one but you - or someone who can see your computer - can answer this. Do
clean-boot troubleshooting to find out.

How to troubleshoot a problem by performing a clean boot in Windows Vista -

Add things back one at a time, testing after each change, to find the
culprit.

Ok that worked and the culprit turned out to be "Backup and Restore Center".
