Mr. Murphy,

I disagree. When I researched the issue prior to buying a new computer
with Vista installed I read many articles concerning the subject. There were
two classifications, Vista compatible and Vista Premium ready.
The articles released by Microsoft, many months before Vista became
available for public purchase, differentiated between Vista compatible and
Vista Premium ready. The articles plainly stated that the Vista compatible
computers were capable of running only the Vista Basic and the Aero feature
would not be available. The articles pertaining to Vista Premium readily
explained that it would allow you to run Aero. Microsoft also explained that
the hardware necessary to run Vista Premium would not necessarily be enough
to run the Enterprise, Business and Ultimate editions.
The articles explained, in depth, that one should have the necessary
hardware to utilize all the features of the advanced versions of Vista. The
articles also explained the necessary hardware.
The fault belongs with the computer vendors who were only too happy to
label their products as Vista capable so that they could push all their old,
outdated hardware that would not work properly with the advanced versions of
Vista.
I don't see any problem with the way Vista was marketed. Any good
attorney should be able to prove that Microsoft did nothing misleading and
that the fault actually lays with the computer vendors whose only objectives
were to eliminate their inventory of old, insufficient hardware and sell
more computers.
I was intelligent enough, and had enough common sense, to read the
articles and understand them. I was not mislead in any fashion. To the
contrary, I took the information provided by Microsoft and purchased a
computer with the necessary hardware to run Vista Ultimate and I have had no
problems whatsoever.
I have no compassion for the people who purchased a "Vista compatible"
computer without researching the matter first. The "Vista compatible"
computers were just that, Vista compatible. This class action lawsuit should
instead be directed at the computer vendors. It is my sincere hope that any
judge and/or jury will understand the issue and dismiss the lawsuit without
prejudice.
This class action lawsuit is nothing more than trial lawyers goading
the people to sue, providing the lawyers with millions of dollars in income.
They could care less about the issue. I see no reason why Microsoft should
not win this lawsuit hands down if the judge and/or jury is subjective and
intelligent. If a judge or jury rules in favor of the plaintiffs then the
judge and/or jury is just as ignorant as the people who purchased a Vista
compatible computer expecting it to be Vista Premium ready and I would hope
that Microsoft appeals the verdict, all the way to the Supreme Court if
necessary.
