I found this online

if it's legal. If so YAY I can return Vista and then buy Ultimate.

If you have not activated the software you can return it, but it's not
something they make easy to do and you may not get any money for it.

Best try reading the selling agreement of MS. You don't actually own their
software. You are told you break their selling agreement is you use it on
more than one machine or if you resell it.

OK you can do all those things till caught.

Perfectly legal if you declined the licence agreement. Not if you've been
using it and just decided you fancy a change.

Ultimate is a version of Vista. What exactly are you trying to do?

Last time I checked Congress writes laws that apply in the United
States, not Microsoft. Further amusement, some MVP giving legal
advise. What's next, Bill Gates stepping forwards and saying he's the
anti-Christ and we all need to get down on our knees every Sunday and
face Redmond Washington and mumble some prayer to Microsoft?

This space reserved for the idiot Frank to start squealing Acer or
Walmart have to do what Microsoft tells them. =====>

Per the license agreement, turning it on constitutes use.
This is OEM software installed and tested by the dealer. It cannot be resold
unless the machine goes with it.

That's like trying on a pair of shoes. If they don't fit, the store
can't resell them to the next guy?

Microsoft's license is highly biased towards themselves for obvious
reasons. As far as the Vista version AFAIK it has not been tested in
the courts as to what is or isn't binding or "legal".

To suggest a customer buys a computer, takes it home, turns in on and
doesn't like the OS and can't replace it with something else without
Microsoft's blessing is absurd and violates the underlying principle
of all laws.

Its bad enough we got guys trying to play computer expert here, now we
got guys trying to play attorney too.

ROTFLMAO!
