Recycle bin icon does not refresh

The recycle bin icon on my desktop does refresh and show that there are no
items after emptyning the contents. The right mouse click shows the "empty
recycle bin" as greyed out and there are no items in it.

Windows Vista 32 bit OS

Any suggestions? Thanks in advance.
