Select License and Windows upgrade

Is it true that Windows Select license agreement requires existing OEM OS
installation on server? That means even if Windows XP or windows 2000
installed on server, server can be upgraded to Windows 2003 Server OS with
Select agreement license software/key,.

In other words, can I first installed Windows XP OS on server and then
install Windows 2003 Server (select license agreement). This way I am
complying Select license agreement terms which says select license can only
be installed on pre-installed OS.

Please help and clarify this. Any web link help greatly appreciated

Hi - you should ask Microsoft directly about any licensing questions.
However:

Select licenses can't use OEM, as far as I know
There's no upgrade from XP to W2003

What you may be thinking of is that a Volume license is in fact a license
for an upgrade. See the last Q on this FAQ:
http://www.microsoft.com/licensing/resources/faq.mspx

But as Lanwench says, best to ask Microsoft Licensing,
