In a pure "agreed to EULA" sense - that is determined by which type of
WIndows XP you had..
OEM - meaning no nice box and 1/2 the price of a retail in most cases - When
your computer died, so did the license you had to use Windows XP (you only
own the right to use it - BTW - you do not own Windows XP.)
RETAIL - Install it.. If it has been more than 120 days since you last
activated - you can activate over the Internet... Otherwise a short phone
call may be necessary to activate it.
