  1. We've recently replaced some domain controllers and have run into a problem
with system state backups on a few of them.

It seems like we are running into the problem described here:
    http://support.microsoft.com/kb/913642

Windows 2003 SP1 security hotfixes through November
The operating system is on C: drive
The AD Database is on C: drive
The Log Files are on the D: drive

The workaround, creating an empty file and including that in your backup job
    seems to work.

The puzzling thing is that servers built from the same procedure are
producing different results. Another recently built domain controller is
configured exactly the same and the backups work fine.

I suppose that calling PSS for the hotfix is the best idea here, I'm just
concerned that it works in one instance but not another.

Backup report from the failing backup.
    Backup Status
    Operation: Backup
    Active backup destination: File
Media name: "SystemState3.bkf created 12/13/2006 at 8:07 AM"

Volume shadow copy creation: Attempt 1.
"NTDS" has reported an error 0x800423f0. This is part of System State. The
    backup cannot continue.
